The WhosRight Privacy Policy (referred to herein interchangeably as "the Policy" or "Privacy") describes how WhosRight.com, and its parent Consensus Media Inc., affiliates, and partners (collectively referred to herein as "WhosRight") treat personal information when you use the WhosRight website and services. To understand how we treat the information you give us with WhosRight, you should read this policy in its entirety. While WhosRight will work hard to protect your information, WhosRight.com cannot ensure or warrant the security of any of the information you submit to us or receive from us. | | | | | B. | Personal Information | | | WhosRight allows you to watch, listen, read or vote on any User Submission without registering WhosRight. You can also contact us about a particular User Submission without registering on WhosRight. Certain other activities on WhosRight—like uploading media, posting comments, completely or accessing a user profile—require you to register with WhosRight. We ask for some personal information when you create a WhosRight Account, including your full name, gender, username, password, email address and any other information necessary for us to provide our services. You can choose not to provide us with certain information, but then you may not be able to take advantage of many of our special features. The personal information you provide may be used for such purposes as responding to your requests for Website related information, customizing the advertising and content you see, and communicating with you about Website features and services. If you choose to provide us with personal information, you consent to the transfer and storage of that information on our servers located in the United States. We may record information about your usage, such as when you use WhosRight, the communities, groups, and favorites you subscribe to, the contacts you communicate with, the media you access, and the frequency and size of data transfers, as well as information you display or click on in WhosRight (including UI elements, settings, and other information). If you are logged in, we may associate that information with your account. We may use clear GIFs (a.k.a. "Web Beacons") in HTML-based emails sent to our users to track which emails are opened by recipients. Any personal information or video content that you voluntarily disclose online (on discussion boards, in messages and chat areas, within your playback or profile pages, etc.) becomes publicly available and can be collected and used by others. In order for you to use our website, you must complete a registration form. As part of this registration form, we require your first and last name, your email address and confirmation that you are 13 years or older. We receive and store certain types of information whenever you interact with our Website or use our services. WhosRight automatically receives and records information on our server logs from your browser including your IP address, cookie information, and the page you requested. Generally, the Website automatically collects usage information, such as the numbers and frequency of visitors to our Website and its components, similar to TV ratings that indicate how many people watched a particular show. WhosRight only uses this data in aggregate form, that is, as a statistical measure, and not in a manner that would identify you personally. This type of aggregate data enables us to figure out how often users use parts of the Website or services so that we can make the Website appealing to as many users as possible, and improve those services. As part of this use of information, we may provide aggregate information to our partners about how our users, collectively, use our Website or services. We share this type of statistical data so that our partners also understand how often people use the Website or services, so that they, too, may provide you with an optimal online experience. Again, WhosRight never discloses aggregate information to a partner in a manner that would identify you personally. We often receive a confirmation when you open an email from WhosRight if your computer supports this type of program. WhosRight uses this confirmation to help us make emails more interesting and helpful. We also may compare our user list to lists received from other companies, in an effort to avoid sending unnecessary messages to our users. For purposes such as improving personalization of our service, we may receive information about you from other sources and add it to our account information. We also sometimes receive updated delivery and address information from our shippers or other sources so that we can correct our records and deliver your next purchase or communication more easily. | | | | | C. | Uses | | | In order to provide you with the Services, you agree to provide certain necessary information during the registration process. Information we collect includes, for example, email address, user name, password, gender, date of birth, country of residence, state/province, city, and zip code. If you submit personally identifiable information to us through any functionality of WhosRight, we use your personal information to operate, maintain, and provide to you the general and personalized features and functionality of WhosRight, and to process any flagging activity or correspondence you send to us. Your account name (not your email address) is displayed to other Users when you upload videos or send messages through WhosRight and other Users can contact you through messages and comments. Any videos that you submit to WhosRight may be redistributed through the internet and other media channels, and may be viewed by the general public. WhosRight will store and process all of your personal information taking care to preserve your privacy and security. The personally identifiable information that you provide will be used by us to provide you with information about products and services available to you. Correspondence from WhosRight may contain commercial messaging, such as advertisements and offers from WhosRight, affiliates, and/or partners. We may use your information to learn more about your visits to WhosRight in order to provide emails about goods and services that may be of interest to you. We may use your email address without further consent for non-marketing or administrative purposes (such as notifying you of major WhosRight Site changes or for customer service purposes). WhosRight will not sell, trade, or otherwise disclose name, address, and phone information to third parties unaffiliated with WhosRight without your permission, unless required to do so in order to comply with applicable law, a subpoena, or other legal process. In the event that WhosRight should be acquired or substantially all of its assets transferred, your information shall be considered a transferable asset. We use both your personally identifiable information and certain non-personally-identifiable information (such as anonymous user usage data, cookies, IP addresses, browser type, clickstream data, etc.) to improve the quality and design of WhosRight and to create new features, promotions, functionality, and services by storing, tracking, analyzing, and processing user preferences and trends, as well as user activity and communications. We use cookies, clear gifs, and log file information to: (a) store information so that you will not have to re-enter it during your visit or the next time you visit WhosRight; (b) provide custom, personalized content and information; (c) monitor the effectiveness of our marketing campaigns; (d) monitor aggregate metrics such as total number of visitors, pages viewed, etc.; and (e) track your entries, submissions, and status in promotions, sweepstakes, and contests. Other Users can contact you through messages and comments. You may also choose to add personal information that will visible to other Users on your personal profile page (which is the public facing page for your account on the site). This may include a profile picture, you name, gender, or other details. Any videos that you submit to the WhosRight Sites may be redistributed through the internet and other media channels, and may be viewed by the general public. | | | | | E. | User Options | | | You may, of course, decline to submit personally identifiable information through the WhosRight Sites, in which case you can still view videos and explore WhosRight, but WhosRight may not be able to provide certain services to you. Some advanced WhosRight features may, for authentication purposes, require you to sign up for other services. The privacy notices of those services will govern the use of your personal information associated with them. You may update or correct your personal profile information and email preferences at any time by visiting your personal profile page. You may control the information that is available to other Users and your confirmed friends at any time by editing your account and the features that are included on your personal profile page. | | | | | F. | Third-party Advertisers, Links to Other Sites | | | WhosRight may share aggregate information collected by WhosRight. with non-affiliated, third-parties. Aggregate information does not identify you, but rather is based upon a summary of information about all users. This aggregate information will help our advertisers better target advertisements and services that are more relevant to you. WhosRight allows other companies and/or business entities (collectively referred to herein as "Third-Parties"), such as third-party ad servers or ad networks, to serve advertisements within WhosRight. These Third-Parties use technology to send, directly to your browser, the advertisements and links that appear on WhosRight. They automatically receive your IP address when this happens. They may also use other technologies (such as cookies, JavaScript, or Web Beacons) to measure the effectiveness of their advertisements and to personalize the advertising content you see. WhosRight does not provide any personally identifiable information to these Third-Parties without your consent or except as part of a specific program or feature for which you will have the ability to opt-in or opt-out. However, please note that if an advertiser asks WhosRight to show an advertisement to a certain audience (for example, men ages 18-34) or audience segment (for example, men ages 18-24 who have viewed certain channels of content) and you respond to that advertisement, the advertiser or ad-server may conclude that you fit the description of the audience they are trying to reach. The advertiser may also use information regarding your use of WhosRight, such as the number of times you viewed an ad (but not any personally identifiable information), to determine which ads to deliver to you. You should consult the respective privacy policies of these Third-Parties for more information on their practices and for instructions on how to opt-out of certain practices. WhosRight's Privacy Policy does not apply to, and we cannot control the activities of, such other advertisers or web sites. Any data obtained by third-party ad servers subsequently shared with WhosRight is maintained and dealt with by WhosRight in accordance with this Privacy Policy. | | | | | G. | Your Responsibilities | | | You are responsible for maintaining the confidentiality of your email address and password that you designate during registration. You agree to immediately notify WhosRight of any unauthorized use of your email address, screen name or password or any other security breach and you agree to exit from your account at the end of each session, especially if you are using public computers and networks. Additionally, you should be careful when inputting your email address and password in public settings, so others are not able to view this information. WhosRight will not be liable for any damage or loss due to your failure to comply with this provision. You are solely responsible for your interactions with other members on WhosRight. As such, you should not give out any personally identifiable information such as your last name, personal email addresses, instant messenger addresses, personal URLs, telephone numbers and physical addresses to other members. Additionally, you should not give out any financial information or transmit electronically or physically any money to other members. You acknowledge and agree that WhosRight has no responsibility or obligations to you in the event that you choose to meet other Users or visitors of WhosRight.
